1. Acceptance of Terms
By accessing or using Workia.dev, you confirm that you are at least 18 years of age (or the age of majority in your jurisdiction), have the legal capacity to enter into a binding agreement, and accept these Terms in full. If you are using the Platform on behalf of a company or other legal entity, you represent that you have the authority to bind that entity to these Terms.
We reserve the right to update these Terms at any time. We will notify you of material changes via email or a prominent notice on the Platform. Continued use after the effective date of changes constitutes acceptance of the revised Terms.
2. Platform Use
Workia.dev is an AI-specialist freelance marketplace that connects clients who need AI and automation work with qualified freelancers. We provide the platform infrastructure, matching, messaging, and payment processing, but we are not a party to any contract between clients and freelancers.
You agree not to:
- Use the Platform for any unlawful purpose or in violation of applicable regulations.
- Post false, misleading, or fraudulent project listings or freelancer profiles.
- Circumvent the Platform to conduct transactions outside of our payment system.
- Harass, threaten, or abuse other users of the Platform.
- Attempt to gain unauthorised access to any part of the Platform or its infrastructure.
- Scrape, crawl, or systematically extract data from the Platform without prior written consent.
- Upload malware, viruses, or any code intended to damage or disrupt the Platform.
3. User Accounts
You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You must provide accurate and complete information when registering and keep your profile information up to date.
Freelancer profiles are reviewed by our team before being made publicly visible. We reserve the right to suspend or permanently remove any profile that violates these Terms, contains false information, or does not meet our quality standards. Clients are responsible for evaluating freelancer proposals and qualifications before entering into any agreement.
You may not create more than one account per individual or organisation without our express written consent. Duplicate or fake accounts will be removed without notice.
4. Payments & Commissions
All payments on Workia.dev are processed via Stripe and held in escrow until a milestone is approved by the client. By using our payment services, you also agree to Stripe's Terms of Service.
Platform Commission (10%)
Freelancers pay a 10% platform fee on each completed milestone payment. This fee is automatically deducted from the milestone amount before funds are transferred to the freelancer. Clients are not charged a platform fee.
Escrow & Releases
Client funds are held in escrow upon milestone creation. Funds are released to the freelancer only when the client approves the delivered work. If no action is taken within 14 days of a delivery submission, the milestone is automatically approved and funds are released.
Refunds
Milestones that have not yet been approved may be cancelled and refunded to the client. Once a milestone is approved and funds are released to the freelancer, the payment is non-refundable. In cases of proven fraud or significant non-delivery, our dispute resolution team may intervene.
5. Intellectual Property
Upon full payment for a completed milestone, the freelancer assigns all intellectual property rights in the deliverables to the client, unless the parties have agreed otherwise in writing within their project contract. Freelancers retain the right to reference the project in their portfolio unless the client explicitly requests confidentiality.
Workia.dev retains all intellectual property rights in the Platform itself, including its design, code, branding, and content. You may not reproduce, distribute, or create derivative works from Platform content without our prior written permission.

6. Disputes
In the event of a dispute between a client and a freelancer, either party may raise a dispute through the Platform's built-in dispute resolution process. Our team will review the evidence submitted by both parties and make a fair determination within 10 business days.
Workia.dev acts as a neutral mediator and our decisions regarding escrow release are final and binding with respect to the Platform. We are not a legal arbitrator and our dispute resolution service does not preclude either party from seeking legal remedies through the appropriate courts.
Disputes between users and Workia.dev itself shall be governed by the laws of France and submitted to the exclusive jurisdiction of the courts of Paris, France, except where mandatory consumer protection laws in your country provide otherwise.
7. Liability
Workia.dev provides the Platform on an "as is" and "as available" basis. We do not warrant that the Platform will be uninterrupted, error-free, or free from harmful components. We do not vet every project or guarantee the quality of freelancer deliverables beyond the matching and vetting process described on the Platform.
To the maximum extent permitted by applicable law, Workia.dev shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or in connection with your use of the Platform, including but not limited to loss of profits, data, goodwill, or business opportunities.
Our aggregate liability to you for any direct damages shall not exceed the total fees paid by or to you through the Platform in the three months preceding the claim.
8. Termination
You may close your account at any time by contacting us at support@workia.dev. Upon account closure, your public profile will be removed. Pending escrow funds will be handled in accordance with the escrow terms above.
We reserve the right to suspend or terminate your account at any time if we determine, in our sole discretion, that you have violated these Terms, engaged in fraudulent activity, or pose a risk to the Platform or its users. In such cases, we will provide reasonable notice unless immediate action is required to protect the Platform or other users.
Upon termination, all licences granted to you under these Terms will immediately cease. Provisions that by their nature should survive termination (including payment obligations, intellectual property, liability, and dispute resolution) shall continue to apply.
